On this section of the website you will find miscellaneous paperwork for people going to civil court. Please use the categories listed below to find the paperwork that applies to your situation. Please remember, the assistance you receive on this site is no substitute for legal advice. If you can, talk with an attorney.
You can find forms on the statewide Court Assistance Program website for a civil case debtor’s exam: www.courtselfhelp.idaho.gov. Look under forms: other misc. civil, then under civil enforcement. There are a motion and an order for a debtor’s exam and a general set of instructions for those forms.
When a person dies, an affidavit may be used if he or she did not own real estate and had personal property with a net value of less than $100,000. The affidavit allows a successor to collect any property, money or other items owed to the deceased. The successor would complete the affidavit and sign it in front of a notary. The affidavit is not filed with the court.
