The management of estates of “Intestate” taxpayers of Ada County is found in Idaho Code, Title 14: Estates of Decedents

An individual passes away “intestate” by not having a will and/or not having heirs or creditors who will step forward to probate the estate.

Probate is the court process by which the estate (accounting for all assets, resolving all claims, and distributing of money in excess of administration costs) of an individual is administered.  The Treasurer obtains “status”, as Public Administrator, through a Courts filing at 60 days after death.  In most cases, Ada County cremates all Public Administration individuals.

Ada County, on average, handles between 10 and 20 public administration cases a year.
