Civil Division

Thirteen deputy prosecutors work within the Civil Division. The attorneys are engaged in a varied government and civil practice on behalf of Ada County, representing the Board of Ada County Commissioners, the Ada County Sheriff, the Ada County Treasurer, the Ada County Clerk/Auditor/Recorder, the Ada County Assessor, the Ada County Coroner and the Boise City/Ada County Housing Authority. The Board of Ada County Commissioners oversees 9 departments such as Recreation and Event Services (Expo Idaho/Western Idaho Fair, and Barber Park), County Administration, County Operations, Solid Waste Management, Information Technology, Indigent Services, Development Services, Juvenile Court Services, and Emergency Management, all of which are represented by the Civil Division. The Division also represents the Emergency Medical Services and Weed and Pest Districts.

Representation of Ada County includes researching and drafting advice letters and legal opinions for elected officials and department heads, negotiating and preparing contracts and real estate and construction documents, preparing ordinances and resolutions, advising officials on personnel matters, and drafting and reviewing findings of fact and conclusions of law in administrative board proceedings.

The Civil Division practices in all phases of civil litigation involving Ada County, before both state and federal courts, including the U.S. Supreme Court. Cases are handled from the beginning of litigation through the appellate process. The Civil Division practices in bankruptcy, county welfare and mental health, civil rights, personal injury, collections, construction and real estate, emergency communications, drug asset forfeitures, land use, legislative processes, probate and guardianships, personnel and benefits, open meetings and public records, and property taxation. During the 2010 fiscal year, the division had 1,177 open cases in federal and state court in all the above-noted practice areas.

The Civil Division, on behalf of the interests of the citizens of Ada County, provides assistance as needed to the Idaho Association of Counties, the Fourth District Court, and the Idaho Prosecuting Attorneys Association.

Internships are offered to third-year law students and externship to second-year law students.
